New case notes released today

Some interesting OIA issues are covered in new case notes published by the Chief Ombudsman today.

One case shows how the Ombudsman approaches complaints by third parties about an agency’s decision to release official information. The agency’s process and decision was reasonable in this case. 

Another case found that an extension of the time limit for responding to an OIA request was reasonable to enable kanohi ki te kanohi consultation, in recognition of tikanga Māori.

The last case discusses the need to withhold ‘without prejudice’ communications between the parties to a legal dispute.
